Kionel Terms of Use

Kionel is open-source software published by Taha Bayar, a sole proprietorship registered in Türkiye ("Kionel", "we", "us"). These terms govern the use of the website kionel.com and the copy of Kionel served from it. "You" means the person using them. The licence of the software itself is described in section 1; these terms do not take away any right that licence gives you.

1. Software licence

• Kionel application, protocol and site: GNU Affero General Public License,

version 3 (AGPL-3.0). You may use, study, change and share the software under that licence. If you distribute a changed version, or run one as a network service for others, you must publish its source under the same licence.

• Record verifiers (the packages and tools listed in LICENSING-MAP.md):

Apache License 2.0, so a record can be checked by anyone, years later, without us and without AGPL obligations.

• Commercial licence: organisations that want to embed Kionel in a

closed-source product or service, or cannot meet the AGPL's obligations, can obtain a commercial licence under a separate written agreement.

• Third-party components are licensed under their own terms, listed in

THIRD-PARTY-NOTICES.md.

The source code is published at https://github.com/Apeiron01/kionel. "Kionel" and the Kionel logo identify the original project; a changed version should not be presented as the original.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live. You may not use the hosted site if you are, or act for, a person or entity that is subject to sanctions administered by the United Nations, the European Union, the United Kingdom, the United States or Türkiye, or if you are located in a country or region subject to comprehensive sanctions under those regimes.

3. Acceptable use

Kionel moves data between devices that may not be connected to any network. That makes it useful, and it makes misuse possible. You may use it only on devices, systems and data that you own or are expressly authorised to access and to move data from. In particular, you may not use it:

• to take data out of, or bring data into, a system or network in breach of the

security policy of the organisation that operates it;

• to transfer data you have no legal right to transfer, including personal data

without a lawful basis, trade secrets of others, or classified or export-controlled information without the required authorisation;

• to transfer malware, or content that is unlawful where you or the recipient

are;

• in any way that breaches applicable law, including sanctions and export

control law.

Kionel does not inspect or scan file content. You are responsible for checking files before you open them on a sensitive system.

4. High-risk use

The software is not designed for use where its failure or delay could lead to death, personal injury, or severe physical or environmental damage — for example in the operation of nuclear facilities, aircraft navigation or control, life support, weapons systems or emergency services.

5. Security and verification

The protection the software provides depends on how it is used. Before accepting a two-way transfer, the operator must compare the codes shown on both screens; a typed one-time code must be shown only on the receiving device and entered only on the intended sender; a receiver card must be installed over a route your organisation trusts. The limits of the software are published on our security and limits pages. Kionel has not yet had an independent security audit.

6. Your data

The transfer software runs on your devices. File contents are not sent to us. You are responsible for the data you transfer, for having the right to transfer it, and for your own validation obligations (for example ISO/IEC 17025, GLP, GMP or 21 CFR Part 11). Kionel does not certify your compliance; published measurements and security analyses do not replace your own validation. Contact messages are processed as described in our privacy notice.

7. Support

The open-source edition comes without support or guaranteed response times. Questions and bug reports are welcome as GitHub issues or through the contact form. Support and service levels are available only under a separate written agreement.

8. Warranty

To the maximum extent permitted by law, the software and the hosted site are provided "as is" and "as available", without warranties of any kind, as also stated in sections 15 and 16 of the AGPL-3.0. Optical transfer depends on lighting, cameras, screens, distance and angle; we do not promise a particular speed, success rate or device compatibility.

9. Liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, data or goodwill, arising from the free software or the hosted site. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.

10. Export control

The software contains strong cryptography. You are responsible for complying with the export, re-export, import and use rules that apply to you, including those of the European Union, the United States and Türkiye.

11. Earlier purchases

Kionel no longer sells licences or subscriptions. Records created with an earlier paid licence remain yours, are never locked and stay verifiable with the Apache-2.0 verification tools. Every feature that once needed a licence is now available in the open-source edition.

12. Governing law

These terms are governed by the laws of the Republic of Türkiye. If you use the site as a consumer, you keep the protection of the mandatory consumer law of your country of residence.

13. Changes

We may update these terms; changes apply from publication. Material changes are announced on this page at least thirty days in advance where the law requires it. These terms are written in English; a translation is for convenience, and the English text prevails.
